Doha: The Department of Islamic Research and Studies at the Ministry of Endowments and Islamic Affairs (Awqaf) has released the fourteenth book in the Research and Scientific Papers series, focusing on jurisprudential principles in exchange contracts. The book, authored by Qatari researcher Abdulaziz Mohammed Al Jaber, spans 280 pages.
According to Qatar News Agency, Director of the Department of Islamic Research and Studies Sheikh Dr. Ahmed bin Mohammed bin Ghanem Al-Thani explained that the book is a scholarly thesis submitted for a master’s degree at Qatar University. It highlights the contributions of Hanbali jurists in deducing jurisprudential principles within transactional chapters, focusing on sales, salam contracts, and leasing, within the school of Imam Ahmad ibn Hanbal.
He noted that this publication contributes to introducing the Hanbali methodology in transaction jurisprudence. It aligns with the Ministry’s efforts to support Qatari researchers and encourage serious Islamic studies through the Research and Scientific Papers series, dedicated to publishing distinguished academic theses in Islamic sciences.
The book aims to demonstrate the impact of deducing jurisprudential principles in exchange contracts by analyzing jurisprudential applications in sales, salam, and leasing. It employs three main methodologies: inductive, analytical, and applied, to study the principles, extract them from the school’s texts, analyze, and apply them to both classical and contemporary jurisprudential issues.
The book features a preliminary introduction and three main chapters. The first chapter addresses the use of jurisprudential principles in sales, the second in salam contracts, and the third in leasing. A preliminary chapter discusses the concepts of deduction, jurisprudential principles, and exchange contracts.
A key finding of the research is that Hanbali jurists permit reliance on jurisprudential principles in the absence of explicit texts and recognize the designation of a principle as universal despite certain exceptions. The book also covers contemporary issues such as installment-based sales and criteria for price determination using indicators.
In conclusion, the researcher recommends applying jurisprudential principles to address emerging financial exchange contracts, support contemporary jurisprudential reasoning, and enhance the flexibility of Islamic jurisprudence in adapting to changes.
The Research and Scientific Papers series, launched by the Ministry of Endowments and Islamic Affairs in 2018, is dedicated to publishing distinguished scientific research to support Qatari researchers in jurisprudence and Islamic studies and to promote the status of scientific research in society.
